Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the QTC Infotech website (qtcinfotech.com) and any services we deliver. By using the website or engaging us for a project, you agree to these Terms. If you do not agree, please do not use the website or our services.
1. Who we are
QTC Infotech is a brand operated by two associated entities, which deliver different categories of work:
- QTC Merchants (OPC) Private Limited — CIN: U74999HR2016OPC065744, GSTIN: 06AAACQ4431A2Z2. Handles reseller, hosting and Android application services. Registered office: H. No. 1311, Urban Estate, Jind, Haryana — 126102, India.
- QTC Technologies — sole proprietorship of Ms. Nancy Bindal. Handles website design, web development and digital marketing services.
The terms “we”, “us”, “our” and “QTC Infotech” refer to the appropriate entity for the service you have engaged. The terms “you”, “your”, “Visitor”, “User” and “Client” refer to the website visitor or the customer engaging our services.
2. Use of website content
All logos, trademarks, brand names, layouts, copy, images, illustrations and other content on this website are either owned by QTC Infotech or used under licence. Unauthorised reproduction, distribution, public display, or commercial reuse of any content is prohibited without our prior written permission. Personal, non-commercial browsing is permitted.
3. Acceptable website use
You agree not to:
- Attempt to probe, scan, breach, or interfere with the security of the website (penetration testing without prior written consent is prohibited).
- Transmit content that is unlawful, defamatory, abusive, infringing, obscene, or otherwise objectionable.
- Use the website to send unsolicited communications or to scrape data in violation of our robots.txt or rate limits.
Violations may result in civil or criminal liability under the Information Technology Act 2000 and other applicable Indian laws.
4. Service engagements
The following terms apply when you engage us for any project, retainer, or one-off service:
- Quotes and proposals: Prices and timelines on the website are indicative. Your final scope, deliverables, milestones and price are governed by the written proposal we send you and your written acceptance (email is sufficient).
- Project initiation and renewal date: The start date of a project is the renewal date for any subsequent renewal period (for hosting, domain, retainer, or care plans).
- Payment terms: Unless otherwise agreed in writing, an upfront engagement fee is required to start work. The balance is due on completion. We reserve the right not to launch or hand over the finished work until the final invoice is settled.
- Content from you: You are responsible for timely submission of content (copy, images, logos, access credentials). Delays in content submission may extend the project timeline proportionally.
- Domain & hosting renewals: Renewal fees are charged annually. If you wish to transfer your domain or hosting to another provider, request the EPP/transfer code in writing at least 30 days before expiry. We will share the code at no cost.
- Project hold: If a project is paused for more than 30 days due to non-response from you, we reserve the right to re-prioritise our schedule. We will make reasonable efforts to communicate before doing so.
- Handover: The website or deliverable is handed over as a fully functioning, completed work. Future support is not included unless an ongoing support or care plan has been agreed.
- cPanel / admin access: When admin access is handed to you, we are not responsible for changes made by you or your agents after handover.
5. Refund & cancellation
Refund and cancellation rules are covered in detail in our separate Refund & Cancellation Policy. In summary: full refund if the project has not commenced, partial refund if started but not completed, no refund for projects near completion or already launched.
6. Intellectual property and ownership
On full payment, the deliverables we produce specifically for you (custom code, designs, content) become your property, except for third-party components (open-source libraries, plugins, themes, stock images) which remain subject to their original licences. Our internal frameworks, methods, tools and pre-existing IP remain our property. You represent that any content you provide to us (logos, copy, images, brand assets) is owned by you or you have permission to use it.
7. Confidentiality
Any non-public information you share with us during a project is treated as confidential and is used only for delivering your engagement. Where mutually beneficial, we may sign a separate Non-Disclosure Agreement (NDA) on request.
8. Limitation of liability
To the maximum extent permitted by applicable Indian law:
- QTC Infotech, its directors, officers, employees and agents shall not be liable for indirect, incidental, special, consequential or punitive damages arising out of your use of our website or services.
- Our aggregate liability to any client for any cause of action shall not exceed the amount paid by that client to QTC Infotech in the twelve months preceding the claim.
- We disclaim all warranties (express or implied) other than those that cannot be excluded under Indian law (such as the Sale of Goods Act and Consumer Protection Act warranties).
9. Indemnity
You agree to indemnify and hold harmless QTC Infotech, its directors, officers, employees and agents from any claim, action, liability, loss or damage arising out of your breach of these Terms or applicable law (including your provision of infringing content to us).
10. Third-party links and services
Our website may link to third-party websites (for example, our portfolio links to client sites or partner platforms). We are not responsible for the content, security, or privacy practices of those external sites. References to third-party tools and platforms are made for identification only and do not imply endorsement or affiliation.
11. Privacy and cookies
How we handle your personal data is governed by our Privacy Policy and Cookie Policy, which form an integral part of these Terms.
12. Modifications
We may amend these Terms at any time by updating this page. Material changes will be highlighted via a banner on the homepage or by email for active clients. Continued use of the website or services after the updated Terms are posted constitutes acceptance.
13. Force majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, pandemics, power outages, internet outages, government action or strikes. We will resume performance as soon as reasonably possible.
14. Termination
We reserve the right to suspend or terminate access to our website or services if you breach these Terms, violate Indian law, or present a security or reputational risk. Sections related to indemnity, limitation of liability, confidentiality and intellectual property survive termination.
15. Acceptance of terms by minors
Our services are intended for businesses and adults. Users under the age of 18 must obtain parental or legal-guardian consent before engaging our services. We do not knowingly collect personal data from minors via this website.
16. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Jind, Haryana, India, and, for consumer disputes, the National Consumer Disputes Redressal Commission (“NCDRC”) as applicable.
17. Severability and waiver
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right under these Terms is not a waiver of that right.
18. Electronic communications
By using the website or engaging our services, you consent to receive electronic communications from us (project updates, invoices, transactional notices). Marketing emails are sent only with your explicit opt-in.
